TERMS AND CONDITIONS

1. Purpose and acceptance

These Terms and Conditions ("the Terms") govern access to and use of the Nivela AI app and website ("the app" or "the service"), operated by NivelaAI Analytics (company in the process of incorporation; "we"), contact email hola@nivelaai.com.

By creating an account or using the app you accept these Terms in full. If you do not agree, you must not use the service. The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

2. Description of the service

Nivela AI is an application that uses artificial intelligence to analyse padel videos recorded by the user, in order to provide a technical score, shot classification and recommendations for improvement. The service also includes optional social features (player groups, ranking, challenges) and notifications.

3. Registration and user account

• You must be at least 14 years old. If you are younger, you may only use Nivela AI with the permission of your parents or legal guardians.
• If you upload videos showing other people, and especially minors, you must have their permission or that of their parents or guardians.
• To use Nivela AI you need to create an account with a valid email address (directly or via Google/Apple).
• You are responsible for keeping your login credentials confidential and for all activity carried out from your account.
• You must provide truthful information when registering. We reserve the right to suspend accounts with false details or fraudulent use.
• You can delete your account at any time from the app; see section 4 of our Privacy Policy regarding data deletion.

4. Content you upload

By uploading a video or a profile photo, you declare that you have the right to do so and you grant us a limited, non-exclusive and revocable licence to store and process it for the sole purpose of providing the service to you (generating your analysis, displaying your photo where appropriate within the app). We do not use your content to train models for purposes unrelated to the service, nor do we transfer it to third parties for commercial purposes.

It is forbidden to upload content that:

• Is not yours, or for which you do not have the authorisation of the people who appear in it.
• Is illegal, offensive, or infringes the rights of third parties.
• Does not correspond to the purpose of the app (analysis of padel videos).

We may remove content that breaches these conditions and, where appropriate, suspend the account responsible.

5. Social features and groups

By joining or creating a group, you accept that part of your information (name, profile photo, scores, activity) will be visible to the other members of that group, as described in section 6 of the Privacy Policy. You are responsible for whom you invite and which groups you join. You can leave a group at any time.

6. Notifications

If you enable push notifications, we will notify you of events such as your analysis being ready or new activity in one of your groups. You can disable them at any time from Settings within the app, or by revoking the notification permission on your device or browser.

7. Acceptable use

By using Nivela AI you undertake not to:

• Use the service for purposes other than those intended, or in a way that could damage or overload it.
• Attempt to gain unauthorised access to Nivela AI accounts, data or systems.
• Reverse engineer, copy or commercially exploit the app or the analysis model without express authorisation.
• Impersonate another person or provide false information about your identity.

8. Plans and paid features

Nivela AI currently offers a free version of the service. Some advanced (Premium) features are under development; in the meantime, you can join the waiting list from the app. When payment becomes operational, we will publish here the specific conditions regarding price, billing, renewal and cancellation before any charge is activated — you will never be charged without your explicit and informed consent.

9. Intellectual property

The app, its design, brand, software and analysis model are the property of NivelaAI Analytics or its licensors. You are granted no rights over them other than personal use of the service in accordance with these Terms. You keep ownership of the videos and photos you upload.

10. Availability and limitation of liability

We work to keep the service continuously available, but we do not guarantee uninterrupted or error-free operation (maintenance, technical incidents, force majeure). To the extent permitted by law, we are not liable for indirect damages arising from the use of the service, nor for decisions taken solely on the basis of the results of the AI analysis.

11. Changes

We may update these Terms to reflect changes in the service or in the applicable regulations. We will notify you of relevant changes by email or by a notice in the app. Continued use of the service after a change implies its acceptance. The date of the last update always appears at the top of this document.

12. Termination of the service

You can stop using Nivela AI and delete your account whenever you wish from the app. We may suspend or terminate your access if you seriously or repeatedly breach these Terms, notifying you where reasonably possible.

13. Governing law and jurisdiction

These Terms are governed by Spanish law. For any dispute, the parties submit to the courts and tribunals that correspond under the applicable consumer protection regulations. If you are a consumer, you may also use the European online dispute resolution platform.
